Electronic Cigarettes and the California Electronic Cigarette Excise Tax

The popularity of electronic cigarettes has increased rapidly among young people in many countries. The US National Youth Tobacco Survey (NYTS) estimates that in 2015, 1.6 million high school and 500 000 middle school students reported using an electronic cigarette. The product’s marketing and design are key in increasing its appeal among youth. Recent studies have associated television commercials featuring the product with increased use among students.

The aerosols produced by electronic cigarettes are similar to those from conventional cigarettes, and the aerosols can cause damage to human cells. Further studies are needed to determine the long-term health consequences of exposure to e-cigarette aerosols. In addition, the inhalation of aerosols can cause inflammation of the respiratory system and reduce lung function, and it can aggravate chronic obstructive pulmonary disease.

Although most countries have adopted minimum age-of-purchase policies, they have had little impact on the number of youth who use the electronic cigarette. Many youths can easily purchase the product online because of the lack of age-verification measures used by vendors. Additionally, delivery companies rarely check the age of the purchaser before delivering the product.

The California Electronic Cigarette Excise Tax (CECET) is a tax on electronic cigarettes that contains nicotine. This tax applies to the total selling price of an electronic cigarette. As of July 1, 2022, retailers will be required to collect 15% of the retail price of an electronic cigarette that contains nicotine. This tax is part of the Healthy Outcomes and Prevention Education (HOPE) Act.

Electronic cigarettes are battery-operated devices that produce an aerosol of nicotine and flavorant. This aerosol is produced by heating a metal coil that is embedded in the E-Cig device.
